1. Agreement to Terms

By accessing or using HowdyCal ("the Service"), operated by Chris Lambert, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

HowdyCal is an AI-powered calendar assistant that allows you to create, manage, and interact with your Google Calendar using voice commands and natural language. The Service includes, and may be expanded to include:

Voice-to-calendar event creation using speech recognition and AI
Calendar viewing, event management, and scheduling
AI-powered scheduling suggestions, conflict detection, and calendar analysis
Smart event formatting with automatic location resolution, duration estimation, and recurrence detection
Automated calendar management features such as proactive scheduling, follow-up reminders, and event optimization
Multi-calendar coordination and attendee management
Calendar insights, analytics, and pattern-based recommendations
Integration with additional calendar providers and productivity services
Notifications, alerts, and proactive scheduling assistance

3. Account & Access

To use HowdyCal, you must sign in with a Google account and authorize access to your Google Calendar. You are responsible for:

Maintaining the security of your Google account
All activity that occurs through your use of the Service
Ensuring the accuracy of event information you provide via voice or other input

You may revoke HowdyCal's access to your Google Calendar at any time through the app's settings or your Google Account permissions.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorized access to the Service, its systems, or other users' data
Interfere with or disrupt the Service's infrastructure or performance
Use automated tools, bots, or scripts to access the Service beyond normal use
Reverse-engineer, decompile, or attempt to extract the source code of the Service
Use the Service to transmit harmful, abusive, or objectionable content
Resell, redistribute, or sublicense access to the Service without written permission

5. AI-Generated Content

HowdyCal uses artificial intelligence to interpret your voice input and generate calendar events. You acknowledge that:

AI interpretation may occasionally be inaccurate — event titles, times, locations, durations, or other details may not perfectly match your intent
You are responsible for reviewing events before confirming them and for verifying that created events are correct
AI-generated suggestions, scheduling recommendations, and calendar insights are provided as assistance and should not be relied upon as the sole basis for important scheduling decisions
The AI's capabilities, accuracy, and features may change over time as the Service evolves

6. Third-Party Services

HowdyCal integrates with third-party services including Google Calendar, Google Maps, Deepgram, and Anthropic. Your use of these services through HowdyCal is also subject to their respective terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.

7. Intellectual Property

The Service, including its design, code, AI models and prompts, and branding, is owned by Chris Lambert. Your calendar data and personal information remain yours. By using the Service, you grant us a limited license to process your data as described in our Privacy Policy solely to provide and improve the Service.

8. Service Availability & Changes

We aim to keep HowdyCal available and reliable, but we do not guarantee uninterrupted access. We reserve the right to:

Modify, suspend, or discontinue any part of the Service at any time
Add, change, or remove features without prior notice
Impose usage limits or restrictions as needed to maintain service quality
Introduce paid tiers or features in the future (existing free functionality may change)

9. Limitation of Liability

To the maximum extent permitted by law, HowdyCal and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Missed, incorrect, or duplicate calendar events resulting from AI processing
Scheduling conflicts, missed appointments, or other consequences of relying on AI-generated events
Loss of data, including calendar data, settings, or account information
Service interruptions or unavailability
Actions taken by third-party services integrated with HowdyCal

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify and hold harmless Chris Lambert and HowdyCal from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at our discretion, with or without cause and with or without notice. Upon termination, your right to use the Service ceases immediately. You may stop using the Service and disconnect your Google Calendar at any time. Provisions that by their nature should survive termination (including Limitation of Liability and Indemnification) will remain in effect.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected on this page with an updated "Last updated" date. Continued use of HowdyCal after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the jurisdiction in which the operator resides.
